Right to Cancel: Consumer Contracts Regulations

The Consumer Contracts Regulations gives you rights, such as the right to cancel a contract/agreement. The Consumer Contracts Regulations gives you key cancellation rights when you enter into contracts, for example, at a distance over the phone, online, from a catalogue or face-to-face with someone who has visited your home.

  • You have 14 days from entering into a service contract in which you can cancel it (starting from the day after you entered the contract).


  • The trader shouldn’t start providing the service before the 14 day cancellation period has ended, unless you have requested this.


If you request a service that starts straightaway 


  • In this instance you will still have the right to cancel, but you must pay for the value of the service that is provided up to the point you cancel. For example, if you buy a service like gym membership and start using the gym and then change your mind within this 14 day time period, you will be refunded but could be charged for the amount of gym time you used.


If the service is provided in full within 14 days 


  • The right to cancel can be lost during the cancellation period if the service is provided in full before the 14 days elapses.  


Exemptions 


  • There are some contracts where you won’t have a right to cancel a service. For example, hotel bookings, flights, car hire, concerts and other event tickets, or where the trader is carrying out urgent repairs or maintenance.


Ways to Cancel


  • You can cancel either over the phone or in writing.


  • The trader needs to provide, or make available, a standard cancellation form to make cancelling easy (although you aren’t under any obligation to use it). Therefore, I have provided downloadable cancellation letter templates in the grey section and the blue section below.   


  • To cancel a contract, you can ask for the form'Letter to cancel a service arranged online, over the phone or by mail order' - use this letter template to cancel a service that you agreed or paid for online, over the phone or by mail order. You can do this during the 14 day ‘cooling off’ period. It should help the trader understand your point of view and their legal obligation to sort out the problem. You can send the letter by post or copy the text into an email. If you’d prefer to talk to the trader on the phone or in person you could read it out to them. Therefore, I have provided a copy of the letter template in the grey coloured section below; simply copy or download it and enter your own details.


  • Alternatively, to cancel a contract, you can ask for the form 'Letter to cancel goods or services bought at home or in a public place' - use this letter template to cancel an agreement you made to buy something when you were at home (yours or someone else’s), at your workplace, in a public place or at a trade show. You can do this during the 14 day ‘cooling off’ period. It should help the trader understand your point of view and their legal obligation to sort out the problem. You can send the letter by post or copy the text into an email. If you’d prefer to talk to the trader on the phone or in person you could read it out to them. Therefore, I have provided a copy of the letter template in the blue coloured section below; simply copy or download it and enter your own details.


Further to you requesting a service that starts straightaway or is provided in full within 14 days


  • As part of your request to carry out work for you, if I have to order/purchase any item(s) for which I cannot obtain a full or partial refund (for example, an item that has to be specially made), you will owe me the full or partial amount that I have not been refunded, even if you cancel within 14 days from entering the contract with me.
